Privacy Policy

 

This privacy policy (hereinafter, the “Privacy Policy”) applies to all personal data you provide to Fundación AYUDA EN ACCIÓN, located at calle Serrano Anguita 13, Impact Hub Barceló 28004, Madrid (hereinafter “Ayuda en Acción”). Personal data is understood to be information about a natural person that allows his or her identification, directly or indirectly. We process your personal data, based on the current relationship you have with us, and which may have been provided through different means, such as, among others, a web form, participation in one of our campaigns and the request to receive e-mail updates about our activities. In this policy we explain how Ayuda en Acción protects and ensures the security of your personal data, using appropriate and adequate technical and organizational security measures.

 

I- DATA CONTROLLER

Ayuda en Acción, as data controller, is concerned about compliance with the legal obligations regarding the protection of personal data, in particular, complying with our information obligations. In addition, we are at your disposal for any questions or concerns that may arise in this regard. At any time, you may contact us either by e-mail at lopd@ayudaenaccion.org or by post by sending a letter to the Personal Data Manager of Ayuda en Acción at Calle Serrano Anguita 13, Impact Hub Barceló 28004 Madrid, with any questions or concerns you may have regarding the protection of personal data.

 

II- PURPOSES OF PROCESSING AND LEGITIMATION

For the purposes of the provisions of Regulation 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (‘GDPR’), we inform you that Ayuda en Acción will process the personal data you have provided us with for the following purposes and under the legal basis detailed below:

Recipient of our intervention (beneficiary of legal age) Identify the recipients of our intervention in order to adapt it to the needs and context in which we work, as well as to carry out awareness-raising actions and be accountable to our stakeholders for training purposes and/or to promote our activity. Your consent to the processing of your personal data, in the following exceptional cases: i) when witness statements are made that include sensitive data, and/or ii) when personal data of beneficiaries of our Social Action program in Spain are transmitted to collaborators, financial and/or media agencies based outside Spain and/or the European Union and that do not offer an appropriate level of protection in terms of privacy and protection of personal data.

Certify your status as an employee in terms of suitability and reputation.
Raise awareness and report on Ayuda en Acción’s activities.
Fulfill the contractual obligations arising from the existing relationship, as well as those related to social security and social protection, labor and legal matters, and provide the necessary measures for preventive or occupational medicine and evaluation of the working capacity of our employees.
Collaborating company Report on your collaboration Fulfill the contractual obligations arising from the existing relationship.
Anyone interested in supporting us (supporter) Share institutional information with you, including via e-mail, to keep you updated on our activities. Your consent to the processing of your personal data.
Anyone interested in supporting us (volunteer) Promote Ayuda en Acción’s volunteer programs. Your consent to the processing of your personal data.
Anyone interested in attending Foundation events or activities Manage your participation in the event or activity. Fulfill the contractual obligations arising from the existing relationship.
Reporting party and/or concerned party (report) Manage the reports filed through the whistleblowing channel. Fulfill our legal obligations.
Informant (query, suggestion and complaint) Manage queries, suggestions and complaints received through the communication channels provided. Fulfill our legal obligations.
Member of the Board of Trustees or Advisory Council Manage their appointment as a member of the body to which they belong, as well as facilitate the proper performance of it.
Certify their status as a member of the Board of Trustees or Advisory Council in terms of suitability and reputation.
Publish their career path on the Web.
Raise awareness and report on the Ayuda en Acción’s activities.
Fulfill the contractual obligations arising from the existing relationship, as well as fulfill our legal obligations.
Supplier Manage and administer Ayuda en Acción’s supplier management, i.e. payment of invoices. Fulfill the contractual obligations arising from the existing relationship.
Supporter Manage your relationship as a partner, i.e., process your donations, send tax certifications, know your satisfaction level, increase your commitment through increased donations or participation in specific actions, among others.
Share institutional information with you, including via e-mail, to keep you informed about our activities.
Inform about the work of our partners, as well as raise awareness and report on the Ayuda en Acción’s activities.
Fulfill the contractual obligations arising from the existing relationship.
Third party registering a new supporter Manage incidences that may arise regarding the supporter’s relationship. Your consent to the processing of your personal data.
Volunteer Manage and administer Ayuda en Acción volunteers.
Certify their status as a volunteer in terms of suitability and reputation.
Inform about the work of volunteers, as well as raise awareness and report on the Ayuda en Acción’s activities.
Fulfill the contractual obligations arising from the existing relationship, as well as fulfill the obligations related to the social security and social protection.

 

In some cases, we will process personal data in relation to your image, for which your consent will be sought when deemed necessary and the processing is not covered by any of the above purposes and legal bases. 

Ayuda en Acción informs you that if you are a user of our website we may create an automated file with the personal data you provide us with, which could be used for the purpose of statistics, incident management or market research, among other activities. Such processing will be based on the legitimate interests of Ayuda en Acción. Failure to provide certain personal data will prevent us from providing all the services for which such data is necessary.

 

III- DATA RETENTION PERIOD

We will retain your personal data for the time necessary to fulfill the purposes described above in accordance with the legal bases that enable the processing. Without prejudice to the foregoing, the retention will also be carried out for the period necessary for the filing, exercise or defense of potential claims and/or as long as permitted by applicable law. In the latter case, your personal data will only be processed for the purpose of proving compliance with legal or contractual obligations to which we are subject.

 

IV- DATA RECIPIENTS

In no case will we communicate, exploit your personal data or use them for any purpose other than the one detailed above. It is worth mentioning that the data may be communicated to employees and collaborators of the Fundación AYUDA EN ACCIÓN who need to know information about you in order to carry out tasks related to the purposes indicated above. 

To this end, we inform you that your personal data may be transferred to other offices of the Fundación AYUDA EN ACCIÓN, which will apply the same technical and organizational security measures to ensure the proper processing of your personal data. In the event that you wish to sponsor children residing in Mexico, we inform you that your data will be communicated to manage your sponsorship to the organization Ayuda en Acción de México Asociación Civil, which has sufficient security. 

Some organizations that collaborate with Ayuda en Acción, such as media agencies, travel agencies, or financial institutions, among others, may have access to your data as data processors, so that we can carry out our work. Sometimes this third party may be located in countries outside the European Economic Area that do not offer an appropriate level of security according to the GDPR. In these cases, we sign a written contract between both parties that includes standard contractual clauses according to standards approved by the European Commission for the transfer of personal information outside the European Economic Area. In any case, the transfer, retention and management of your personal information by us will continue to be governed by this Privacy Policy. 

We also inform you that the data related to your contribution will be communicated to the Tax Agency in order to process your tax benefits, as well as to those other control authorities that request your data as long as all the legally established precepts are respected.

 

V- YOUR RIGHTS

Ayuda en Acción informs you about the possibility of exercising your rights of access, rectification, deletion, portability and limitation of the processing of the personal data we have collected. 

Additionally, you have the right to object to the processing of your personal data in the cases set out in the applicable data protection regulations. 

These rights may be exercised, by yourself or by anyone representing you, by means of a written and signed request addressed to the Personal Data Controller of Ayuda en Acción, through:

This request must contain the following information: your name and surname(s), address for notification purposes, photocopy of your National Identity Card or Passport, and the specific request. In the case of representation, you must prove it by means of a certified document. To send this request you can use the forms provided by the Spanish Data Protection Agency, which can be signed electronically. 

In addition to the above rights, if it is the legal basis for the processing of your personal data, you also have the right to withdraw the consent given at any time through the procedure described above, without such withdrawal of consent affecting the lawfulness of the processing prior to the withdrawal of consent, and without in any case condition the processing of personal data carried out under any other legal basis. Ayuda en Acción may continue to process your personal data to the extent permitted by applicable law. In general, we respond to requests within one month, although depending on the complexity and number of requests, the deadline may be extended for a further two months, in which case we will notify you. 

Finally, we remind you that you have the right to file a complaint with the relevant regulatory authority.

 

VI- MODIFICATIONS TO THE PRIVACY POLICY

Ayuda en Acción reserves the right to modify its Privacy Policy in accordance with the applicable legislation at all times. In any case, you may consult any modification of the Privacy Policy on our Web page.
