Co-responsibility
Good faith guides the use of the channel with reasons, evidence or objective indications that show the existence of the irregularity. The right to take legal action in case of bad faith is reserved.
Registration and data review
We will review the complaints received within a maximum period of 10 working days, guaranteeing at all times a serious, transparent and confidential handling thereof.
How to report?
Any person may file a complaint through this channel, which is freely and publicly accessible, and through any device. You can do it confidentially or anonymously.
Guarantees
Mechanisms are in place to ensure the confidentiality of data and the absence of retaliation. If the investigation concludes inappropriate conduct, additional guarantees will be considered if your identity is known.
What happens once the report is made?
From this moment on, a five-step process will begin:
1. Request for additional information to be provided.
If after reviewing the information received, we consider that it is not clear or incomplete, we may ask you to expand it through the channel, with a maximum period of 15 working days to send it. This request will be made through the whistleblowing channel, which allows us to maintain a dialogue regardless of whether the report is anonymous or confidential. Therefore, it is important that you access the channel periodically to follow up on the management of your report.
2. Preliminary analysis.
With the information received, and within a maximum period of 10 working days, we will determine whether the complaint is relevant and, therefore, merits the initiation of an investigation. This will be decided based on its veracity and clarity, the relevance of the facts reported and the sufficiency of the information provided to proceed with any further action.
3. Opening of the investigation process.
If it is necessary to initiate an investigation, the team responsible for the investigation shall be appointed within a maximum period of 5 working days. This team must initiate the investigation within a maximum of 10 working days from its appointment, and the investigation may be carried out within a maximum of 60 calendar days from the completion of the preliminary analysis, extendable for a maximum of 60 calendar days if the person(s) concerned have not been identified. If all the evidence necessary to conclude the investigation has not been obtained, the nature and complexity of the case justifies a longer investigation, or for other reasons that duly justify it.
4. Communication to the affected person(s).
This will be done by e-mail within a maximum period of 15 working days from the beginning of the investigation or from the time his/her identity is known, in order to ensure his/her rights, among others, the presumption of innocence and the right of defense, including the right to be heard and the right to access his/her file. Once the person has been notified, he/she shall have a period of 20 working days to exercise his/her defense, providing in writing any arguments he/she deems appropriate for his/her defense and to provide any documents he/she may deem of interest.
5. Resolution and closure of the investigation.
Once the investigation is concluded, a decision will be made as to whether improper conduct has occurred. If so, within a maximum period of 15 working days, the appropriate disciplinary sanction will be established for the person(s) affected.
